Our Process

This is how MiM's Process works.

  1. Click on Need a Mediator on our homepage.
  2. Fill in an on-line mediation referral form.
  3. MiM will email an automated email invite to the other party to attend a preliminary meeting to consider mediation.
  4. The above email prompts the other party to select a mediator from the MiM panel to convene a confidential and entirely free joint preliminary meeting at which the mediator will:
    1. First, explain the process and benefits of mediation to the parties;
    2. Secondly, and only if the parties decide to proceed, assist them to conclude an agreement to mediate providing for:
      • the appointment of a suitably qualified mediator;
      • the date, time, place, cost and other relevant terms.
  5. At the preliminary meeting the parties are free to appoint any MiM mediator of their choice. (This could be the mediator who convened the meeting or any other mediator from the MiM panel - for example one with knowledge and experience in the field in which the dispute arose).
  6. The parties thus have absolutely nothing to lose and everything to gain by attending the preliminary meeting.
  7. Should the other party fail to select a mediator within 7 days to convene the preliminary meeting, MiM emails a reminder and confirms receipt of the invitation.
  8. If the other party still fails to select a mediator within 3 days after the above reminder, MiM will furnish the party that requested mediation with a certificate that the other party has refused to attend the entirely free preliminary meeting to consider mediation.
  9. Should the matter proceed to trial the certificate may become relevant when the court apportions liability for the costs of the trial.
  10. MiM sends an automated email to the mediator who convened the preliminary meeting, requesting that the mediator completes an online progress report.
  11. MiM sends an automated email to the mediator who the parties select to mediate their dispute at the preliminary meeting, requesting that the mediator completes a final online progress report
